These Terms of Service are an agreement between you, a parent or legal guardian, and FOP Shkabko R.A. about the use of the Mova iOS app, the website and the parent cabinet (together, the "Service"). By creating an account or letting your child use the app you accept these Terms on your own behalf and on behalf of your child.
1. What the Service is
Mova helps a child learn English on their own: every day the app offers a short lesson and tests, and for a passed test the child earns minutes of screen time. On the child's phone the app limits the categories of apps the parent chose (for example games, social media or video) and unlocks them for the earned minutes. How many minutes a test is worth, whether unused minutes carry over to the next day and whether notifications are sent is decided by the parent in the cabinet.
2. Who can use the Service
An account may be created only by an adult parent or legal guardian. A child does not register: the parent creates the child's profile in the cabinet and connects the child's phone with a one-time code. You are responsible for the child's use of the app and for keeping the code, the account and the Screen Time settings on the phone under your control.
3. Your account
Keep your sign-in details secret and tell us at [email protected] if you suspect someone else has used your account. You may connect several phones to one child; the minute balance is shared between them. You may deactivate or delete a child's profile in the cabinet at any time and delete the whole account by writing to us (see the Privacy Policy).
4. Minutes and rewards
- Minutes are a feature of the Service, not money or property. They have no cash value, cannot be bought, sold, transferred or exchanged for anything outside the app.
- Minutes are earned by the rules shown in the app: a passed test brings the reward set by the parent, an excellent day brings a bonus, and a failed test can be retried after a pause.
- If the parent has turned carry-over off, unused minutes expire at the end of the day (UTC). The parent may change rewards at any time; the change applies from the next day.
- We may correct a balance that appeared because of a bug, misuse or an attempt to cheat the tests.
5. Screen Time on the child's phone
App limits are enforced by Apple's Screen Time technology on the phone itself, within the categories the parent selected there. The Service does not see which apps are installed or used and cannot limit anything outside those categories or on devices where the app is not set up. A child who can change the phone's settings can bypass the limits — the Service is an agreement between you and your child, not a lock, and we do not promise that the limits cannot be circumvented.
6. Acceptable use
You agree not to: break, reverse-engineer or overload the Service; automate answers or otherwise cheat the tests; access other users' data; copy the lessons for redistribution; or use the Service in a way that is unlawful or harms others. We may suspend or terminate an account that does so.
7. Price and payments
The Service is currently free of charge. If we introduce paid features or a subscription, they will be sold through Apple's In-App Purchase inside the app, with the price shown before purchase; billing, renewal, cancellation and refunds will follow Apple's App Store rules, and we will update these Terms before any charge is made. Free features that exist at that time will stay described in the app.
8. Content and intellectual property
Lessons, texts, audio, images, the vocabulary, the app and the website belong to FOP Shkabko R.A. or our licensors and are provided for personal, non-commercial family use. The answers your child gives are used to grade the test and to improve the lessons; you keep any rights you have in them. The name Mova and the logo may not be used without our written permission.
9. Availability and changes
We work to keep the Service available, but it may be interrupted for maintenance, updates or reasons beyond our control. We may add, change or remove features, and we may discontinue the Service with reasonable notice to parents. New lessons and levels are generated and reviewed continuously; a lesson may contain a mistake, and we are grateful for reports at [email protected].
10. No guarantee of results
Mova is a learning aid and not a substitute for school, a tutor or your own involvement. We do not guarantee any particular progress, level or grade. The Service is provided "as is", without warranties of any kind beyond those that the law does not allow us to exclude.
11. Limitation of liability
To the extent permitted by law, FOP Shkabko R.A. is not liable for indirect or consequential loss, lost data, or loss caused by a child bypassing the limits, by the phone's settings, by Apple's services or by circumstances outside our control. If we are found liable, our total liability for the Service is limited to the amount you paid us for it in the last twelve months, or, if the Service was free, to 1 000 UAH. Nothing in these Terms limits liability that cannot be limited by law, including for consumer rights and for intentional harm.
12. Termination
You may stop using the Service and delete the account at any time. We may suspend or terminate an account that violates these Terms or the law, or if the Service is discontinued. After termination the minute balance is lost and the data is deleted as described in the Privacy Policy.
13. Terms required by Apple
The app is distributed through Apple's App Store, so the following also applies:
- These Terms are between you and FOP Shkabko R.A. only, not Apple. Apple is not responsible for the app or its content.
- The licence to use the app is limited, non-transferable and valid on Apple devices you own or control, as allowed by the App Store Terms of Service.
- Apple has no obligation to provide maintenance or support for the app; we are responsible for it and can be reached at [email protected].
- If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the extent permitted by law Apple has no other warranty obligation, and any other claim is our responsibility.
- We, not Apple, are responsible for addressing any claim relating to the app, including product liability, legal or regulatory requirements and consumer protection, and for the investigation and resolution of any claim that the app infringes third-party intellectual property.
- You confirm that you are not in a country under a U.S. Government embargo or designated as "terrorist supporting" and are not on any U.S. Government list of prohibited or restricted parties.
- You must comply with applicable third-party terms (for example your mobile data agreement) when using the app.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
14. Governing law
These Terms are governed by the law of Ukraine. Disputes are resolved by negotiation first; if that fails, in the courts of Ukraine, unless the consumer-protection law of your country of residence gives you a right to your local courts.
15. Changes to these Terms
We may update these Terms. The date at the top shows the current version. For a change that matters we tell parents by email or in the cabinet before it takes effect; continuing to use the Service after that date means you accept the new Terms.
